  • Russell Lichtenstein is a partner in the firm and Chairman of the firm's Employment & Labor and Casino Defense Litigation practice groups.

Russell is certified by the Supreme Court of New Jersey as a Civil Trial Attorney and has been recognized as one of the premiere trial attorneys in New Jersey. He has been named as a "Super Lawyer" and one of New Jersey's "Top Attorneys" in the employment litigation field by New Jersey Monthly Magazine in each year they have made that designation from 2004 through the present. He has also earned the distinction of being recognized by the New Jersey Supreme Court and a Certified Civil Trial Attorney and by the National Board of Trial Advocacy as a Certified Trial Advocate. He has an impressive collection of favorable jury verdicts in employment matters. Russell is generally regarded as one the most successful and effective management-side employment litigators in New Jersey.

Russell understands the maze of legal issues impacting the business world, guiding and defending a wide range of businesses and institutions throughout New Jersey. While his expertise as a former prosecutor has given him the investigative, analytical, and courtroom skills to mount an aggressive defense of any claim or allegation, it is his gift for strategic planning and negotiation that just as often will help employers avoid a dispute - or bring it quickly to resolution. By keeping abreast of the trends and precedents in the constantly changing field of employment law, he is able to show his clients how to avoid costly mistakes - or how best to minimize their impact. Settling disputes before they reach litigation is always the preferred approach, and equipping employers with effective, proactive measures, and offering prompt assistance early in the process are the keys to his success. Of course, there are times when an aggressive, tenacious defense is exactly the right response, and in those instances, Russell moves from consensus-building to prosecutorial assertiveness.

He favors a coordinated approach to employment litigation, combining his clients' industry-specific knowledge and insights with his own considerable strengths as an advocate. As one of the principal legal resources for New Jersey's gaming industry, for example, he understands that each business has its own culture and its own way of handling its business affairs. By taking the time to discern those differences, he is able to work with his clients to help prevent or solve problems before they reach the summons and complaints stage. This "team" strategy often begins with a thorough audit of policy manuals and employee attitudes and perceptions. It can include a review of disciplinary procedures and recommendations for preemptive or proactive measures to avoid or defuse potentially threatening situations. And always at the heart of these attorney-client relationships is open, ongoing communication.

Russell had the breadth and depth of experience necessary to guide clients through the ever-expanding maze of employment and labor laws, rules and regulations, both state and federal that impact their businesses on a daily basis. In the 30 years that he has been with Cooper Levenson, Russell has successfully defended cases brought under every conceivable theory against employers including, for example, claims brought under the New Jersey Law Against Discrimination, the New Jersey Conscientious Employee Protection Act, the New Jersey Wage and Hour Law, Title VII, the Age Discrimination in Employment Act, the Older Worker Benefit Protect Act, the Americans With Disabilities Act, the Fair Labor Standards Act and the WARN Act. He regularly appears in matters in the state and federal courts of New Jersey and before the administrative agencies, which address employment issues. Additionally, he has been admitted in other jurisdictions to assist clients around the country in a variety of employment related matters. Complimenting his employment practice, Russell also has an expertise in traditional labor-law matters including contract negotiation, contact drafting, providing guidance on the daily issues that arise in a unionized workforce and defending Unfair Labor Practice charges before the NLRB.

In his capacity as the Chairman of the firm's Casino Defense Litigation practice group, he acts as one of the firm's lead trial counsel representing the firm's casino clients. On a day-to-day basis he interacts with the casinos' risk management departments as well as coordinating activities with other departments (facilities, security, housekeeping, construction, maintenance, etc.) in the defense of claims.

Before joining Cooper Levenson in 1983, he served with distinction as an Assistant Prosecutor in Cape May County. A graduate of Temple University (B.A., 1978) and Western New England College School of Law (J.D., 1981), he was admitted to practice law in the State and Federal Courts of both Pennsylvania and New Jersey in 1981 and is a member of the New Jersey, Pennsylvania, Atlantic County and Cape May County and American Bar Associations. Russell is active in many civic and charitable organizations and formerly served two terms as President of the Jersey Shore Council of the Boy Scouts of America.
