DAMAGE: Purchaser shall be liable for any and all damages to Artist?s instruments or equipment caused by Purchaser, his guests, members of his organization, business invitees, or employees.. PROMOTION: Purchaser shall be entitled to advertise and promote the appearance of Artist at the Performance. Artist acknowledges that Purchaser may rely on the terms hereof in all such promotions and advertising both in print and broadcast setting forth the names, dates, and times of all performances to be held. Artist hereby acknowledges and agrees that Purchaser may use their names, photographs, likeness, facsimile signature, and any other promotional materials in all of such promotions, advertising, or other activities used to increase attendance at the Performance.. PARKING: Purchaser shall provide parking space for equipment and passenger vehicle(s) in a location of close proximity and with direct or reasonably unobstructed access to the stage area where Performance will take place on the date(s) of Performance. Parking will be available for Artist for a period of time prior to the Performance sufficient to allow for equipment load in and again immediately following the Performance to allow for equipment load out.. DRESSING ROOMS: Purchaser shall provide Artist with one private dressing room, which will be clean, dry, well lit, and air conditioned with sufficient seating for all performers.. OUTDOOR PERFORMANCE: If performance is outdoors, an alternate inside location will be provided or purchaser assumes all weather-related risk. Artist will be due full wage agreed upon in the event of inclement weather unless the event is moved to alternate location prior to set-up. Artist will only set up once and will not be required to move the equipment to alternate location after set-up has begun.. THE ARTIST, leader, manager, or representative of the Artist agrees and guarantees to pay 10% of FULL WAGE AGREED UPON for personal services, booking fee, Contract fee, and telephone expense rendered and incurred in this transaction to Agent. This commission is due and payable when all parties have signed this Contract and must be paid within five days after the date that the Artist is to perform for the Purchaser except where Agent has already retained said commission from the deposit already paid by Purchaser. If leader or key personnel of this group is rebooked into this or any establishment represented by the Purchaser (including chain buyers of entertainment) within 13 months from the Performance(s) set forth in this Agreement, Purchaser and leader shall be jointly and severally liable for payment to the Agent for commission in the rate set forth herein.. THE AGREEMENT of the Artist to perform is subject to detention or prevention by sickness, accidents, riots, strikes, epidemics, acts of God, or any other legitimate conditions beyond their control. In such case, either there shall be no claim for damages by either party to this Contract and the deposit will be refunded in full to Purchaser or Agent will take reasonable measures to provide a suitable alternate Artist. No substitutions shall be made unless the Purchaser authorizes the substitution.. THIS CONTRACT constitutes the sole, complete, and binding agreement between the Artist and the Purchaser. Agent and its employees act only as agent, consultant or manager, and assume no responsibility or liability as between the Purchaser and the Artist. Covenants herein contained between said Artist, their leader, manager or representative, and Agent are intended to be binding as between said Artist, their leader, manager or representative, and Agent.. If you give me a job to complete, and you tell me that I will make the same amount of money regardless of the time it takes me to complete it, you have just motivated me to work on it more quickly, because I receive time as an award. Some people are motivated by money. If you need something completed by a certain date, a cash reward is the ticket for these people. Be careful with this, because cash is usually a finite instrument for most companies. hi, one of our tenants,(calll him sid) told us a few months ago that he was bipolar and we were very sympathetic, he's had a tough time, his marriage broke up last year and he found out the electrician is seeing his ex wife now, and they had been together before sid broke off his marriage. we have got to hand him notice because a few weeks ago he started a fight with another tenant while drunk and there was no reason. we have realised a routine with him. he works very hard for a month, he loses concentration easily, offers to help us with things then does something else. drives off very fast and wheel spins on our gravel, returning late at night and crying in his room. then, when his rent needs to be paid he hands it us (he's very quick usually giving us rent a day early whilst the other two always hand in weeks late), then he'll disappear for the rest of the day and come back with carrier bags full of wine (i mean LOADS. he fills those wine carrier boxes and hides them in bags. the next thing we know he locks himself in his room and, at the moment he's doing this, he hasnt come out of his room for 3days now. my dad wandered if he was hurt the first time he did this and went to see if he was ok, he tapped the door and sid was sitting in the corner of the room with all the blinds shut, surrounded by empty bottles and a milk carton filled with pee!. until we knew that we felt sorry for him but now im beginning to feel unsafe around him, he scared me slightly, we dont know whether he lied to us about being bipolar, but he certainly seems alcoholic, can you be both? and is there anyway we can stop him from doing this? i need to go next door and clean you see, its not fair on the other's to live in an unclean house..
