Matt's health law practice includes advising clients with regulatory compliance and medical malpractice issues. We have been renting a small house for 4 years, and have been excellent tenants. Recently we began searching for a home to purchase, but have been discouraged by what's available in our price range. We really love our rental home, but are ready to make the transition to home ownership.. . We decided to ask our landlords if they might be interested in selling the home we are renting to us. They have responded that the might be interested, and we will be discussing this with them soon.. . My question is... what sort of professional should we be working with to represent us in this process? A realtor? A lawyer? We already have been working with a lender and are pre-approved for a loan. We had were working with a realtor but recently decided to "fire" him because he has not been meeting our needs at all. So right now we are in limbo without a realtor.. . C has $50,000 in the bank. A & B have an enduring power of attorney in QLD, Australia over the financial and medical affairs of C. Either can act independently of the other on these matters. C is terminally ill with cancer. A lives interstate, and B lives with C. In the 12 months leading to death of C, B spends the $50,000 on personal and other household expenses during this 12 month period. When A discovers that the account is reduced to $10,000 they ask B and C what happened to it. Both are vague and non-commital in answering. Knowing that C will die soon, A suggests to both B & C to attribute the remaining bank funds to pay for the impending funeral. Both agree. 1 week before C died, B requested, and obtained a $1000 advance lump sum payment on C's pension benefit (which was spent following the same pattern). B managed the bank account into a debt position of $1,000. C died leaving A and B as estate executors. All money is left to A and B equally in the will. B assures A that everything is being taken care of, and A didn't have to contribute to the cost of the funeral. A receives a demand notice on the estate for the bank and pension debt. A requests bank statements (under rights of an executor) and finds that B has utilised the account after death. A then exercises their power of attorney to gain bank statements for the period from when the power started until date of death, thus uncovering what has happened.. . a) what should A do?. b) is A required to report the statements to police to proceed criminal investigations?. c) If B was receiving a carer's pension for that whole period, does that affect your opinion?. d) does the fact that B has a 3yr old and 15 yr old children affect your opinion?. e) Can A be implicated in any criminal matter?. f) What laws has B broken (if any)?.
