My Grandma just appointed my uncle "durable" power of attorney over her. She chose him over her husband and the family is really torn up over it because we do not get along with her brother at all. I need to write a letter to the former owner of my business,who is continuing to use her old business checks to write bouncing checks to previous vendors. These checks have my DBA on them, which is the same as her old one, but we bought the DBA when we bought the business. Where can I find a template for a letter of this type?. . Thanks!.

In the US....... . If it is a defined contribution plan (401(k), profit sharing etc.) the account goes to the spouse. If no spouse than the employees' estate.. . If it a defined benefit or pension plan, most plans provide a survivorship benefit for the spouse which is about 50% of the benefit the employee was entitled to when he passed away. This is the minimum, some plans provide a larger benefit than this.

That being said the system is currently broken. There are many entities at fault. There are multiple entities to blame, which include physicians, hospitals, big pharma, and consumers (yes we are a big part of the problem).. . Health insurance as most of us know it today is not true insurance. Insurance is the tranference of risk for something that you can not protect your self against. Most people and companies select policies that have a low-copayment for Dr.'s visit and prescriptions and low deductibles. What most people don't seem to understand is that in that arrangement you are prepaying for services you may or may not recieve. In fact the cost of health insurance can be broken down as follows:. . - 50% is for pre-paid servies (co-payments for Dr.'s visits, prescriptions, urgent care or emergency facilities, etc..). - 40% is for catastrophic coverage. - 10% is for access to the network physicians and facilities at discount rates. . So when you think about it 50% of what most of us are paying today we are pre-paying for an unlimited amount of co-payment office visits and prescriptions. That is NOT insurance. People complain that their insurance goes up from year to year, but they have had the same $10 or $20 Dr. visit copay they have had over the last 20 years. Now don't you think the Dr. costs more to go to than it did 20 years ago.
