• Clark is a shareholder in the Litigation Section and heads the firms Employment Law Litigation Practice Group. As a former loan officer with an MBA, Clark brings a business understanding to the realities of employment and oilfield claims. Clark is admitted to practice before the United States Supreme Court, the Fifth and Federal Circuit Courts of Appeals, and all Federal and State Courts of Texas.?In 2007, the Supreme Court of Texas appointed Clark to its 12-member Board of Disciplinary Appeals. As an administrative?court, the Board has all of the powers of a trial court and all the powers of an appellate court necessary to decide cases and appeals where lawyers are alleged to have?violated professional rules of conduct.? Parties?appeal the?Board's decisions to the Supreme Court of Texas.? Clark has chaired the Board since 2009.? Clark is also a board member of the Hospice of Midland Endowment, an?entity managing funds for hospice care, and he also serves on a district panel of the Unauthorized Practice of Law Committe.

  Employment Litigation

  Clark is experienced in resolving employment disputes through his representation of employers. He has successfully represented clients before the EEOC, as well as in Federal and State Courts. Clark has experience litigating claims arising under Title VII, ADEA, FLSA, ADA, and common law causes of action which generally arise in the workplace. He defends employers on claims alleging invasion of privacy, intentional infliction of emotional distress, breach of fiduciary duty, interference with contractual relations, and numerous other causes of action arising out of the employment relationship.

  In addition, Clark has drafted and negotiated employment contracts, severance agreements, non-compete covenants, confidentiality agreements, and other contractual matters arising in the employment context. Clark has also drafted and revised employee handbooks as well as general employment policies. Clark has conducted and supervised employee investigations and has advised clients in employment termination and counseling situations.

  Oil and Gas Litigation

  Clark has broad experience in the arena of oil and gas litigation, having represented clients in lawsuits arising from disputes over the interpretation of Joint Operating Agreements, Area of Mutual Interest Agreements, COPAS Accounting Procedures, Purchase & Sale Agreements, and lease access disputes. Although Clark generally represents operators in oil and gas litigation, he?has represented a non-operator in an Area of Mutual Interest dispute which settled prior to trial for a $9 million payment to his client, and he has represented a client in an oil and gas dispute in which his client reveived a judgment in excess of $8 million. In addition to his experience with general oil and gas litigation, Clark has obtained the appointment of receivers for producing properties and has obtained temporary restraining orders and temporary injunctions in connection with oil and gas disputes.

I told my mentor i wish to attend a research laboratory in the UK for a while. My mentor has just met the chief of that laboratory at a meeting and they just agreed to cooperate for a research project. So I think it should be not impossible for me now to achieve my wish. My mentor told me to write an email or a reference letter he will review sign and forward to the UK lab chief.... I m finding this pretty hard.... I think a reference letter is not appropriate... I think I have to write a sort of...reference email, but I could not find any examples on the net...Could you help me?.

I'm a Nursing Home Administrator I've seen alot of negative things happen to families because they don't have advanced directives or will's or even power of attorney's. We'll start with advanced directives. If a patient hadn't declared what they want then the medical community will do normal protocol. Ex. If a patient has a heart attack, the medical team with revive them to the best of their ability even if it results in brain damage and the patient living as a vegetable or with horrible damages. The process of reviving normally includes cracking the rib cage and a very painful recovery with time in rehab. If the patient ends up as a vegetable with out a living will, they will remain on life support until they die or the doctor decides to cut the cord. Once the patient as passed away the state takes all their assets instead of the family with out a will. And if there is someone you don't want to lay claim to anything... you have no way of dictating that with out a will. The advanced directives let's you choose if you want to be brought back during certain situations like respiratory arrest vs. cardiac arrest. The Living will then deals with the after math of that in that you can designate someone to make decisions for you ONLY WHEN YOU ARE NO LONGER ABLE TO MAKE THEM YOURSELF. Having a Power of Attorney or Living will doesn't mean you sign over your right all it means is that if you are ever unable to make decisions (ex, Alzheimer's, acoma etc...) then someone you trust can make the decisions you would want to have made. Their job is to carry out your wishes not their own. The will is the icing on the cake, it lays out what you want to happen to your things once you are gone. That way it doesn't go to the state first for review, your lawyer has set out the terms and what goes where. If you don't care you can simply put, split my assets evenly between my children. It's simple. I'm 26 and I have a will, I have a power of attorney and advanced directives. It's never too early. I have patients from 24-104... everyone should make their wishes known and if you ever change your mind, you can change all of those things as well.

Heeey, so i want to change my name when i'm 18. I'll also be applying to university at that age too, though. My birth name would be on my high school diploma, so how would i change it ? Or, how would i apply with that diploma but a changed name..?. . thanks!.
