It depends very much on the state. If you do not have POA, or medical POA, the person making all significant decisions will be the nearest blood relative.. . If you don't set up a POA "from carelessness," then you've only yourself to blame.. . Also, be aware that in prop-H8 style states -- where same-sex rights are abrogated by constitutional amendment -- even if you DO have a medical POA the relatives might still shove you out. There have been numerous cases where a same-sex partner was excluded from a loved one's deathbed by "godly" family members.. . Get the medical POA and be sure the lawyer who draws it up for you is prepared to step in and defend it in case of a crisis. Don't just think about it, do it.. . And "homosexuals" is a sneer word. "GLBT," please.
