We are about to put an offer on a house. We are aware of the deed restrictions. Don't like restrictions in general, but am in love with property....so willing to buy. Problem is house needs some work, want to add an attached garage, put in a driveway (it only has a dirt one), put up a nice decorative fence, paint house, new roof........ . In the restrictions, none of this is "banned", but restrictions state that ALL/ANY plans must be approved by the hoa. problem is there is no active hoa, our realtor cannot find the president listed on the deed restrictions, and no other person is listed. I called the county myself and theycould not find the individual either. The restrictions were drawn up by the developer of the community in 1973, and seems he has been long gone. Realtor is positive there is no one to go to to get my plans approved.. . Has anyone ever had a similar problem? How did you deal with it?. . Don't want to go asking neighbor's "permission" to make improvements, as I don't want to open a nicely closed can of worms. in other words, I would be very happy to keep any restrictions/hoa inactive..
