Though, I don't think it's smart to query both publishers and agents at the same time. I'd query agents first. When there are no more agents to query, I'd take a long, hard look at my manuscript because there's most likely a flaw with it if it's been rejected by every agent who reps my genre. I'd revise or rewrite some more before sending it off to publishers. If a publisher shows interest then you can hire a publishing lawyer (make sure s/he specializes in publishing) to negotiate the contract for you. Basically, many of these publisher who take unagented manuscripts also take agented manuscripts. So, as you might guess, with every publisher you're submitting to, you're taking away one publisher that your agent can submit to. It can be harder to get an agent if your manuscript has already made the rounds to many publishers. Agents can't submit a manuscript to a publisher you've already sent it to.
