As a prince, like his 2nd cousin Princess Elizabeth, they both used the older convention of styling their family name after a territory, rather than the roughly 800-1000 year old convention of using surnames. In the political climate of 1947, Phillip disavowed his titles as Prince of Denmark and Greece and became common the week before his wedding. As such, he needed a surname. The natural one was Mountbatten which had been 'invented' by his maternal grandfather in 1917.. Mountbatten was an English translation of Battenberg (which is a little more dignified than the more literal Battenhill). Battenberg was only invented in 1850 to cover a marriage to a woman who was not considered worthy marriage material.. There was a law passed, but it was by Queen Elizabeth herself shortly after she became queen. However, the law was passed with some urging by parliament. The memorandum urging the change which was a state secret in 1952 is now available to the public and can be downloaded. I have it on my google account if you want to read it. It covers the history, the legal precedents, and the recommendation to the Queen. . There are two questions. First, what is the name of the "royal house". While even Phillip probably had no argument that the "House of Windsor" was the correct name for the royal house, he did have a point about the second question. After 2 generations along the male line from a monarch (with the exception of the oldest son of the Prince of Wales) the descendants become non-royal. As such, they require a surname. The decree of George V in 1917 was that these people should use Windsor as a surname, just like the Royal Household territorial name. Phillip wanted them to use Mountbatten.. As the only male descendants in the 3rd generation besides Prince William are Prince Harry, and Viscount James, then the present ruling is that Prince Harry's children will initially be born common and require a surname. But when Prince Charles ascends the throne, they will convert from common to royal. Two things may happen (1) The Queen will be "letters patent" declare Harry's children to be royal from birth, or (2) Harry's children will be born with the hyphenated surname Mountbatten-Windsor. As Phillip is nearly age 90, probably a lot will depend on who is alive at the time. If Phillip has died, the royals may simply change their mind. If Phillip is alive, they may honor his desire to see someone to pass on his name, and the queen will not make his children royal until after he dies.
