• Kevin, who was raised in Butte, focuses his practice on medical malpractice defense, as well as commercial, insurance, and media law litigation.

  Kevin received a bachelor’s degree in journalism in 1987 from the University of Montana, where he served as a reporter and later as the editor of the student newspaper. After graduation, he worked as a news reporter for more than four years, writing about police and legal issues for newspapers in Texas and Montana. He later returned to Missoula to attend the UM School of Law, graduating with honors in 1994. He then worked as a judicial law clerk for the Hon. Charles C. Lovell, U.S. District Court Judge, in Helena. At the end of his clerkship, Kevin joined the Seattle law firm of Davis, Wright Tremaine LLP, where he was a member of the firm’s litigation and communications departments. He is admitted to practice in the state and federal courts of Montana and Washington.

  Kevin is married to Tracey Baldwin, also a lawyer, and they have two daughters. He enjoys rafting the rivers of Montana with his family and competing in ultra marathons throughout the West

Rita knows what she's talking about. I can't say the same for Payola, he has a one-sided, narrow opinion (and we're all entitled to have one, of course).. . In olden days, women and cattle were "chattle". They belonged to the man who purchased (or in the case of women, married) them. Thus the changing of name.

Critique:. . If the legislature wanted the law to mean a certain thing, they should have written that meaning directly into the statute. When a judge looks at the legislative history of the law, the judge is only looking at the decision making process of the legislatures, not necessarily their intent. Thus, looking at original intent by reviewing the legislative history can create interpretations of a statute that may not have been the "actual" intent.. . However, reviewing legislative history is not a bad idea. Many times judges rule on the black letter "four corners" of a statute and end up with absurd interpretations that had nothing to do with the real intend for creating the law. One example would be the ridiculous applications of the Three Strikes Law in California where a shoplifter (Leandro Andrade) received 50 years to life in prison for hiding videos in his pants as he was leaving K-mart.

I am looking for a building to open up a bar/club. The seller of the building has the option to either lease or purchase. I was hoping to set up a 'lease with the intent to purchase' agreement. If the selling price of the building is $250,000, what is a reasonable lease cost? Who pays for improvents to convert the interior and exterior? Who pays property taxes and insurance on the building? Should I receive discounts for permanent improvements I make to the building (such as adding bathrooms, bar, DJ booth)? Is it going to be difficult to get permits, if I don't own the building? What are some website or sources for 'lease to purchase' contracts? And on top of it all, the building might be historic and reside in an 'Empire Zone' (New York Sate's draft enterprize zone, for tax breaks to attract businesses). Any help or advice would be highly appreciated! Thanks..
