Unless your Daddy had an existing Will that he had not revoked where someone other than your mom was named as Executor (to administer the estate), your mom could petition the local probate court to be the administrator of his estate. She will need to file a petition with a certified death certificate and a list of interested parties (ususally spouse and children). The court will probably ask her to submit an inventory and may ask her to post a bond. After she has been appointed, she can pay funeral, doctor, hospital and your Daddy's other bills. Before any money goes to the surviving spouse or children, you'll need to wait for a period of time (often 6 months) to allow any creditors to come forward to make their claims. After that any money left over will be divided among the legatees or heirs according to the law of your state. All this is done will Court oversight and approval.
