• David M. Ottenwess is the Managing Partner of the firm.?He began practicing law in Michigan in 1986 and today concentrates his practice in the area of civil litigation matters, including professional liability claims, general healthcare law defense, contracts, labor and employment, constitutional and election law. For over 27 years, he has successfully litigated cases in Federal District Court as well as in Wayne, Oakland, Macomb, Monroe, Montcalm, Saginaw, Genesee and Washtenaw County Circuit Courts. He has successfully tried cases before juries in Federal and State Court on matters involving medical malpractice, contract disputes, Federal and State Polygraph Protection Acts, employment discrimination (Title VII), industrial accidents and trade mark infringement. Mr. Ottenwess has also successfully handled appeals in both State and Federal Courts capped by his defense of a Michigan Hospital and CEO in a complex matter involving issues of labor law, including Section 302 allegations, and claims of RICO Act violations. This litigation was eventually taken to the United States Supreme Court which ultimately vacated an unfavorable decision against his client by the Sixth Circuit Court of Appeals on the basis of a recently decided case.

  In 2011, Mr. Ottenwess was appointed by a federal judge to serve as a Special Master in the decades-long litigation involving the United States Environmental Protection Agency and the Detroit Water and Sewerage Department litigation.

  Mr. Ottenwess is a member of the Michigan Society?of Healthcare Risk Management, Trial Section Chair of Michigan Defense Trial Counsel, and a Member of Defense Research Institute. In addition, he is a member of the American Bar Association and the State Bar of Michigan. Mr. Ottenwess is admitted to the United States Supreme Court, the 6th Circuit Court of Appeals and the United States District Court, Eastern and Western Districts of Michigan.

  Mr. Ottenwess’ honors in the legal professional include being inducted into the American Board of Trial Advocates, awarded the AV? Martindale-Hubbell Peer Review Rating, the highest rating for legal ability and general ethical standards. Theoretically, each branch of government has 1/3 power. The system of checks and balances is The Executive, Legislative, and Judicial Branch and people who serve and execute the duties while in office are supposed to do whats best for the country. They do this by balancing the budget, making sure that Americas Interests are protected, ensuring product safety, ensuring that services rendered are held to high standards, and setting standards that are to be implemented in new ventures.. . In the past, The Executive Branch has exercised "executive privilege" to the point of breaking the checks and balances system. This gave the impression that the Executive branch was exclusively for power brokers and the ultrarich who would exercise executive privilege beyond what our founding fathers intended. It also gave the impression that the Executive Branch held more power than the other two branches combined because the Attorney General was used by The Executive Branch as the "go between guy" for the Judicial branch, and vice versa to get "legal advice and approval" for overriding previous decisions by creating loop holes.. . In all honesty, The Legislative, Judicial, and Executive Branches would hold close to equal power by the mere numbers of people who work in each branch. Unfortunately or fortunately, the Executive Branch has expanded it's membership many times in the past by creating new "agencies" for special purposes and needs. This has expanded government and complicated not only the balance of power, but has complicated the "intended purpose(s)" of our founding fathers.. . As for the founding fathers, they had wives who were just as educated as themselves. They intended and achieved great things for America and still some people thwart "the idea of government for the people".. . Congress and the Senate are the Legislative Branch. Since they are mostly lawyers or have lawyers who write for them and they make laws and oversee our laws they have the ability to help protect America.

I know this is a lot to ask of the yahoo community but I am putting my hopes in all of you to help provide me with direction. I will see a lawyer, but I'd like to know what you all think too.. . My father is ill and owns two properties. One in which he lives and one that he houses an elderly relative that is legally blind but in good health at age 72.. . Property one (Dad's/primary): Paid 260K (3 yo), owes 150K, mort is 1,200/mo. . Property two (elderly relative/investment): Pain 220K,(5 yo) owes 170, mort is 1,600 which Dad pays.. . Both are in 55plus neighborhoods and Dad feels certain he would like to continue to support this friend for as long as they are alive (it's very important to him and OK with me and my brother).. . Now, my question is, being that any inheritance (120K in a retirement account) and the properties are willed to my brother and me 50/50. My brother and I are fine with continuing the care of this relative but are worried if my fathers assets will last. We are also worried about the transfer of properties to us as the market is so bad and the mortgages would be tough to swing. We already know that If my dad doesn't make it, the relative would move to his place (it's closer and less expensive). A reverse mortgage could also be obtained I think.
