  • Edward J. Walters, Jr. has been representing individuals in personal injury cases for over 35 years. Because of his significant courtroom experience and because of his dedication to the Louisiana and Baton Rouge bar, and to the Louisiana State University Law Center, he recently received a statewide honor being named "Distinguished Attorney" in 2009 by the Louisiana Bar Foundation. You need to appoint her health care power of attorney. You can get the form for health care power of attorney from your hospital. It has to be signed in the presence os a notary public to be legal. All hospitals have this form which gives your partner the legal right to make health care decisions for you if your not competent to do it for yourself. . Its a 2 or 3 page paper . Of course there are always those people out there who try to infringe on a patients right to make her own decision when grandma (or whoever) is perfectly capable of doing it on her own. . Health care power of attorney only takes effect when you are not competent to make your own decisions on your own health care.. If your alert and oriented x 3, and able to make your own choices, your partner, as your health care power of attorney, cannot force you into a treatment you do not want.. Healthcare power of attorney is only for health issues, not property or financial.. As far as her not being allowed in your hospital room. When you sign into the hospital, there is a paper you put the names of people who are allowed to call and visit. Put her name on the person to notify and she will be able to walk in your room anytime she wants. I am a nurse and currently have the same issues going on with my significant others family. . My significant others daughter tried to remove me from his chart as the person to notify and was not able to accomplish it because he signed me as the person to notify when he was admitted. . Also, I dont know about other states, but in Illinois, healthcare power of attorney and durable power of attorney for property are 2 seperate issues and they are not put on the same document. If your sick in the hospital, we dont really care who is settling your estate, but we do care who is making healthcare decisions for you. Also. After you make your power of attorney for healthcare, have copies made and put 1 in a safe or a lock box to keep in case you lose it.
