Whoever told you that the IRS thinks you have to give them $100,000 if you give a family member $100,000 is CLUELESS. The ACTUAL law is that if you GIVE someone more the $13,000 in a year, YOU must complete a gift tax return declaring the amount. If done properly, you can use a unified credit and not actually pay gift taxes. In NO CASE does the recipient pay taxes on a gift received.. At MOST, the gift tax would be 28% paid by YOU.. . If you loan a family member money, you are REQUIRED to charge interest and incojme pay taxes on the interest. They would also have to repay the loan, unless you use the annual gift tax exclusion to 'give' them the payments.. . You should consult an estate planing attorney about how to properly structure what you do to minimize tax consequences.
