  • Mr. Determan received his Juris Doctor degree from the University of San Diego School of Law,? with Honors,?in 1987. He has? received the American Jurisprudence?Award?for excellent achievement.?     Prior to becoming an attorney with the Law Firm, Mr. Determan worked as a negotiation specialist and contract administrator for eight years. He has served as the Senior Subcontract Administrator for General Dynamics Corporation where he evaluated and negotiated contract proposals. He has also served as a contract specialist with the Bechtel Construction Company in Jubail, Saudi Arabia. In these capacities, Mr. Determan negotiated and monitored contracts - contracts often in excess of one hundred million dollars - with numerous multinational corporations. Prior to accepting his positions with the General Dynamics and Bechtel Construction, Mr. Determan served in the United State Marine Corps where he achieved the rank of Captain.

    Since joining the Law Firm, Mr. Determan's practice has included a wide variety of legal issues including all aspects of public school and education law, employer-employee relations law, discrimination and construction law. He has successfully served as lead counsel representing both public and private sector clients in litigation before Federal District Courts, the U.S. Court of Appeals, California Superior Courts, the California Court of Appeals, the California Public Employment Relations Board (PERB), the United States Equal Employment Opportunity Commission (EEOC) and the United States National Labor Relations Board (NLRB). He has represented public sector clients in collective bargaining, in arbitration hearings over disputes arising from collective bargaining agreements and in litigation brought by labor unions challenging the decisions of employers. He has also served as a disciplinary Hearing Officer in disciplinary proceedings.

    While the majority of Mr. Determan's legal practice has been focused upon client defense, he has, on occasion, represented plaintiffs. For example, Mr. Determan served as lead counsel in a sexual harassment case where following a five week jury trial, the jury rendered a judgment of approximately $891,000.00 for his client.? In a recent disability discrimination case, the U.S. Tenth Circuit Court of Appeals upheld an award which totaled more than $700,000.00 to Mr. Determan's client.

    In the area of construction law, Mr. Determan has successfully represented public sector property owners in litigation against contractors, sureties, architects and subcontractors. His extensive and practical experience in the issues of the construction industry he acquired while working for Bechtel Construction, (which is one of the largest construction companies in the world), in conjunction with his extensive litigation experience in construction related matters, provides him a keen insight into construction disputes; an insight shared by few attorneys. Mr. Determan has given seminars throughout California focusing upon the issues encountered before, during and after the completion of public sector construction projects.
