This is a bad idea for several reasons. Here are just a few:. . 1. If your Mother "Gifts" you anything valued at more than $13,000 then she will owe a Gift Tax on her Federal tax return. Make no mistake, taking her name off and putting you name on a deed is a Gift for tax purposes. What ever the value is of the gift, that value will be deducted from her Federal Estate Tax Exclusion amount when she dies. There is no Estate Tax in 2010 but in 2011 and beyond, the Estate Tax Exclusion is $1 million. If her total estate is valued at less than $1 million, then her estate will owe no Estate Tax. Less than 5% of all estates in the United States will owe an Estate Tax.. . 2. There is no Federal Inheritance Tax. An Inheritance Tax is a tax paid by each individual heir according to the amount that they individually inherit. Some states, like New Jersey, have an Inheritance Tax but most states, like California, do not. State Inheritance Taxes are generally far less than Federal Estate Taxes or Federal Capital Gains Taxes.. . 3. If she gifts you her property, she also gifts you her basis cost for the property. So if she paid $10K and it is now worth $110K, your basis cost is still $10K. If you sell the property for $110K, you will owe Federal Capital Gains Tax on the $100K gain. After January 1, 2011, if you inherit the property, you receive a "stepped up basis" to the value on her date of death. Therefore you have no gain so you pay no Capital Gains Tax. The problem with the "No Estate Tax in 2010" is that there is no stepped up basis either. Now instead of less than 5% of all estates having to pay an Estate Tax, all estates will have to pay a Capital Gains Tax. Hopefully Congress will hurry up and fix this mess when they come back into session.. . 4. If she has to go into Assisted Living or Residential Care, there is a 5 year "look back" period for Medicaid. They will look back at her assets for the last 5 years to see where it all went. You could find yourself in a mess under the Financial Elder Abuse Laws as well.. . 5. A Living Trust does not have any effect on whether an estate is taxed or not. If the Estate is valued at over $1 million in 2011 and beyond, the estate will pay Estate Tax. A Living Trust allows the estate to avoid Probate. In California the least expensive Probate is $33,000 which is why a $5,000 Living Trust is a bargain. A Trust also allows the estate to be settled quickly instead of taking months with Probate.. . In general, it is far more advantageous to receive an inheritance than it is to receive a gift. There are less taxes and the basis costs for hard assets (real estate, jewelry, personal property) is stepped up to current market value. Please spend a few hundred dollars and have a consultation with an Elder Law Attorney and a Tax Attorney. They can guide you through the best ways to care for your Mom and Dad financially and legally as well as how to best minimize your tax burden, if any.
