Since I've had several responses, most out of State. I am looking for a Real Estate Professional, or Lawyer to help answer my question. I need someone from NY to assist me. The county involved is Monroe County.. . I am interested in a property that currently does NOT have a mortgage, its 100% paid for. My dilemma is that the house has back taxes on it. 2007 is currently held by a third party, and 2008 is delinquent and held by the county. I know the person will not be able to pay the taxes. I would like to know how to legally obtain the property, before it gets foreclosed, or seized by the town/county. The house is not for sale, and I don't know how to approach the situation.. . I can disclose more information if someone can provide me credentials. Aparently you people don't understand. I want to find out how I can offer to purchase the house from the owner. My last few postings, people actually paid attention that I wanted information from Real Estate Professional, not some person off the street who thinks they know the answer. The more common answers I get, the farther I'll get with it..

Trust are a funny part of the law. It is not a will for the person who benefits has already been named. There are trust that had certain conditions with them that must be meant. There are also problems such as if it was a funded trust, if it was funded and the conditions have been meant then there should be no reason that the trust can not be paid out.. If the trust was not funded then it is funded from the estate of the deceased, in this case all bills must be paid before the trust can be paid out. In this case if there is not enough to pay what was named in the trust then the person named in the trust is out of luck.. The only thing a person named in a trust can do is ask for an audit of the trust and estate. You can not contest it, for it is not a will but a trust. The audit is the way to go.. You did not say in your question or you may not know if it was a funded trust or not and if conditions were put on the trust.. Also it depends on the way the trust was worded, as to if and when it must be paid.. . Some states by lass for example MA, advices all to wait 12 months before paying out unfunded trusts, to ensure all bills from the estate are paid and cleared.
