Your eldest brother is wrong. You do not hold power of attorney. No one does. Power of attorney permits one person (the attorney-in-fact) to act on behalf of another as they themselves might if present. Your dead brother cannot act. Therefor to exercise the power he might himself is to do nothing.

My husband went through this a few years ago (before we were married). Go to your local courthouse to the clerks office. They should be able to get you the proper paperwork. My husband had to go to the local State Police Post to get fingerprinted and they did a background check on him. Once that was cleared, he had a court date set in front of a Judge where the Judge asked him why he wanted to change his last name and the Judge granted it. He was also able to get his name changed on his birth certificate for another fee. Theres a fee for the paperwork to be filed at the court, to get fingerprinted/background check, and then to get the birth cert changed. However, I do not know how this will all work as a minor. If you are her only legal guardian, you shouldn't have a problem. I dont think they'll do a background check on her but I'm not 100% sure. I would just suggest calling your local courthouse clerks office or visiting their office. They should be able to give you more detailed info as far as minors go. Good luck! (congrats on getting a good man that takes care of your daughter even though he may not be her birth father!). . One more thing, we had to run the name change in the local newspaper too giving anyone ample time to dispute the name change request. But I think they have to have a viable explanation for wanting to fight it. The Judge told my husband as long as anyone isn't doing it for legal reasons (like trying to get out of some illegal stuff) they typically grant the request.
