    I am the Plantiff for Negligence, slip and fall, Premises Liability, damages, pain & suffering. This is against the insurance company so I need to take this to municipal court (not small claims)..

    What estate planning did the person do? Did they have a living trust? Was there money in the estate to continue the bills? Did they leave the house to anyone? Does the person it was left to have the money to make the payments? What does the probate judge say? The executor of the estate? The new trustee of the living trust?. . Assuming that there's no money anywhere to keep the payments up, the bank will foreclose to pay the mortgage. It's pretty silly to allow them to do it in most cases, but there you are.
