  • Timothy J. Fitzgerald

    Timothy J. Fitzgerald joined the firm as a member in 2013. His practice focuses on sophisticated commercial and business litigation in Ohio's state and federal trial courts and appeals before Ohio's intermediate courts of appeals, Supreme Court of Ohio, United States Courts of Appeals and the Supreme Court of the United States. Mr. Fitzgerald was one of the first attorneys in Ohio to be certified by the Ohio State Bar Association as an Appellate Law Specialist and was appointed in 2010 to serve as one of the twelve members on the OSBA's Appellate Law Specialty Board which oversees the testing and certification of attorneys in Ohio as appellate specialists. He has represented businesses, insurance carriers, and individuals in complex civil and commercial litigation and is a frequent lecturer and author on appellate practice, legal ethics, and professionalism.

    Mr. Fitzgerald has tried numerous jury and non-jury trials in state and federal courts. He has handled court cases involving securities laws, attorney and accountant malpractice, professional licensure and disciplinary actions, Uniform Commercial Code, contracts, lender liability, fraud and breach of fiduciary duty, intellectual property, civil RICO, corporate law, partnership law, employment law and wrongful discharge, insurance coverage disputes and bad faith, and civil and business tort actions. His impressive appellate practice covers every aspect of the appellate process from providing advice on pre-appeal issue identification, briefing strategies and preserving the record during trial to briefing and presenting oral arguments before state and federal appellate courts.   • James F. Koehler, John N. Neal and P. Wesley Lambert joined in the formation of Koehler Neal LLC to engage in the practice of law commencing January 1, 2011. All three have practiced with one another for numerous years, developing an effective and efficient approach to legal matters. The firm is located on the 33rd floor of Erieview Tower in downtown Cleveland, Ohio.

    Mr. Koehler has practiced law in Cleveland since his graduation from Case Western Reserve University School of Law in 1973. He represents closely-held corporations and their owners, broker-dealers, and registered investment advisors. Over the course of his career, he has prepared SEC filings, handled mergers and acquisitions, and has counseled clients in a wide variety of business transactions and business related litigation.

    Mr. Neal graduated from Case Western Reserve University School of Law in 2002, and has practiced in Cleveland ever since. He focuses on the regulation of the liquor industry in Ohio, and federal licensing and labeling representation. Mr. Neal worked with Eugene Stevens - widely considered an authority on liquor permitting - for several years before formally taking his practice over in 2010. Mr. Neal continues his business litigation practice at Koehler Neal as well, particularly in relation to disputes related to the entertainment/hospitality, food and beverage, and liquor industries.

but my mom had the longer name without the Mc & I went through life with the same name as her She said he died when I was a baby but in Aug. 07, I found out that he died in 1979 & am still checking. Since I'm older, I didn't need a BC till I got married & with the County one with the Mc & shorter name, we just told our City Clerk that it was a mistake & he gave me a new one with the name I had been using all my life. I used it to get married, get a passport & it's on my 3 kids BCs BUT in reality I have 3 different names on 3 BCs but only one is considered "authentic" which is the shorter last name with a "Mc" which I never used. I'm still trying to work with the State office of Vital Records to see how I can correct this mistake but I believe I'll have to petition the court and have it changed to the name I've used all my life & was my father's real last name. I think you have to file a "Change of Name (or what ever it's called in Miss.) form" to tell them what you want to change and attach the father's court papers (copies ) & have your signatures notarized on your application for change. I first spoke on the phone to someone in Vital Records at the State Dept to send me the necessary form & filled it out as requested attaching necessary papers, had wittnesses' signatures notarized and then finally when the form was correct & complete, I had to go & get it notarized just to say that I was who I said I was ( the petitioner). So, I went there once & everything else was done by phone & mail but it took a year to complete. I don't see why you have to have a court order to verify a court order --seems like you need to speak to someone else in Vital Records. Try your County offices for help first, they might be more helpful when they understand what you're trying to accomplish. Again, good luck - since the father's name has already been done - it should not be too difficult to change his name on the child's BC.
