I had a good tenant for the last three years and our relationship throughout all that time was pleasant. Then somtime during the month of March (the month his lease was expiring) he witnesses a crime in the area and he felt his life was in danger hence he contemplated moving. Towards end of March when I called him to find out if we were signing a new lease, I found that he had moved and he had put his friend (with girlfriend and a baby) in the room. I had no problem with the matter but I met with him (my good tenant) and I gave him a list of details I need about the new tenant so as to have a lease with him. (wanted legal proof of being in the country, 3 months bank statement, 2 references, deposit equivalent to 3 months rental - on or b4 1st April 2007). when my request was not honoured, I gave grace period of a week, when that ended I wanted the family to move out (trustees complained of domestic violence). I took my keys, left their furniture outside (now stil where I left it..). The family is currently sleeping in their car, outside my property and their furniture is still where I had put it. They are saying my previous good tenants acted as an agent and took money equivalent to three months rental from them just before they were permited to move into the unit. They gave it to him in cash and they don't have an invoice or nay proof of that deposit. My previous tenant disagrees with what they are saying...I still made them move out as I was not even informed of this when I gave them a list of my requirements. I think they could have raised the flag then not now when I want them out..not only because of money but their behavior and lack of trust.. I am in South Africa and these people are Nigerian with a serious connection with local police. At this point, my safety hasn't been affected in any manner as the man is only abusive towards his woman. I kinda feel given the circumstances, local police would come in only to act against my decisions given there exists a law within SA that says 'you can't make people move without giving them altenative shelter'. This is mostly used on communities of squatters but things can easily turn around.. I have other properties in central Joburg and I have come across other landlords who actually pay people to move out. In this case, I know the reality of the situation is that I want to see these people gone. My previous tenants offered to pay them so they can stay but I said I want them gone...what puzzled me is that he offered behind their back and that giving kinda making me see maybe he did indeed take their money. The abusive man has also been telling the caretaker at my place bad things about my previous tenants ie. he even said he is into drugs!!. I was lucky in a way as I only found the woman and the baby when I went for the keys. She gave me the keys (it was on a friday) understanding 'how they had wronged me' then I left the place open and asked that they be out by sunday lunchtime. I went again sunday lunchtime, the man was not home but with the woman's help we took their things outside as she told me a relative was coming to pick them up. She even wanted to help with the cleaning but I said I will send people at a later stage for that. I locked my unit and then went home. I only knew there was no relative when the man kept calling begging for the keys on sunday evening.. . I will however see a solicitor and see if I was on the wrong side of the law . Please do note that this all happened in April and the lease with my good tenant expired in March..
