There is a problem if your grandmother has Alzheimer's disease -- she may not have the legal capacity to sign a power of attorney. I was involved in three situations in the past 5 years where a person did not have the capacity to sign a power of attorney. This is a decision that should be made by a lawyer after consulting with a family physician because there are different degrees of Alzheimer's. The key is whether somebody has the competency to understand the document they are signing. I am sorry that there is not an easy answer.. . There is also a legal issue probably more of interest to attorneys than to the general public. Who is the client? Is it you? Is it your grandmother? There are issues of potential conflict of interest.. . The power of attorney document needs to be signed by the principal [the person granting the power of attorney]. The agent [the person to whom the power of attorney is given] in some jurisdictions need not sign the power of attorney. In Pennsylvania, there are particular requirements under statute as to both the form and execution of a power of attorney. In Pennsylvania, the agent must sign an acknowledgement that he understands the requirements of the document and that he must maintain separate records on behalf of the principal and must not commingle the principal's funds with his own.

Understand this...if you do not have a letter clearly outlining your agreement, you can not trust them to fulfill anything.. . You don't really need a template letter. Just a simple negotiation letter is fine, but be sure to include the following demands.. . 1) Sell out exactly what you will be paying. How much per month, how many months, and the total paid.. . 2) That they will be accepting this amount as "payment in full" with no further obligations to you. This statement is meant to ensure they don't try to sell the remaining balance off to another collection agency, who will then come after you for the rest.. . 3) A statement they will not file a 1099c on you for the unpaid amount (you will have to pay taxes on it of you do).. . 4) A clear statement that once you have fulfilled your payment plan and paid the agreed amount, they will DELETE this from your credit report. NOT change it to "paid in full" because this does NOT remove derogatory information and will still be a bad mark on your credit.
