Does anyone know? I believe it is the blood son. My grandfather(common law husband, no marriage licenses), thinks he has power of attorney over my grandmother while she is in a nursing home for rehab for the next year or so, meaning he makes any decisions. But the rest of think it is my father(the blood son). Which is it?. We have it on paper that my father is. But my grandfather apparently went up to the hospital she was in before my father got there and said that he was the PoA. And now we have to go through a bunch of crap to change it, now that she is out of state. They've been together 20 years or so. My grandmother is in her right mind, and she has told us she wants my father to be the PoA.. We live in Alabama. The reason we needed a PoA at all is when she was in the hospital, she was in very critical condition and stayed in the CCU for a month or so. He said he was her husband(not mentioning the common law part) and PoA. Now she is down in Florida, and we're not sure what to do. We're going to a lawyer sometime to get it staighten out..
My wife and I have kids and no will yet. I would like something in place rather than nothing. Where is the best form or template to create our own will to download, until we seek a lawyer? If I have to pay a few bucks for it I can. My biggest concern is to make sure our kids don't go through probate court..
