My friend is disabled and often not able to carry out her affairs. Due to this for the past 10 years her son has been her Power of Attorney and Nominee for the Dept. of Works and Pensions. Her son now owing to his business interests is not often availabe to help as he used to and they both agree another norminee should be appointed. Also she has a car through the Motability Scheme which still has over 2 yrs to run and the way it works is although she is the Registered Keeper it is the nominee the car is actually hired out to. How does she go about this, especially with the situation regarding the car as if she is without a car she is absolutely housebound. Has anyone been in a similar position? She phoned a Helpline for disabled but they didn't really seem to know. Thanks..

To the original question, what your friend has done can be considered fanfic, but it can also be considered an infringrement of SM's copyright (as a derrivitive work). Not all authors turn a blind eye to such things. Many authors allow a certain amount and type of fanfic based on the idea that it is part of the marketing of their work (keeps their readers interested in the story), so long as it does not damage their work (which could affect future sales). A few authors forbid fanfic, and some them have attempted legal means to stop it.. . While your friend may not be making any monetary profit off her version of the books, if her other friends continue to promote the derrivations as being better than the original it could be a problem. Would you want someone to take your books, make their own version of them, and then claim to be better than you? Would you not want to legally stop them from damaging your work and reputation? If you next book might not sell because of the fanfic damage, wouldn't you want the legal means to recoup that lost income?. . Doubtful that your friend's work will actually amount to legal measures, or even gain enough popularity for SM or her publisher to notice. However, better safe than sorry (and sorry can be very expensive).. . If your friend truely is a great writier, she should put her efforts into books and ideas of her own, not running amuc in someone else's. .
