A trust is an instrument that places "res" aka "property" in the "trust" of another. It basically allows the trustee to make certain decisions about handling the property in the trust for the benefit of the trust's ascertainable beneficiaries. And there can be several different types of trusts. You can have 100% discretionary trusts where the trustee can basically do whatever they want regarding trust decisions, as long as it doesn't violate their fiduciary duties. (This includes the duties of due care, and the duty of loyalty). Then there are very strict trusts where basically the trustee is more of a straw man, who just goes through the motions, following the directions of the settlor's (trust creator) wishes, regarding the handling of the property. And trusts can either be revocable, or irrevocable by the settlor.. . So in your case, if the owner of the property, put the property in a trust, and it wasn't revocable, then it is now in the hands of the trustee according to the trust terms. And so if the settlor no longer could handle it himself, then neither could the settlor's power of attorney, because decisions of said property would have to be handled as directed in the trust, so it is no longer in the settlor's direction, or anyone who has a power over the settlor.. . The policy behind trusts is to protect assets from creditors and stuff and is usually created to help people who need to have some income without going completely bankrupt. But they can't simultaneously use the trust as a untouchable personal piggy bank, or that would be unfair and everybody would always put everything they own in a trust.

For Example- As a drafting company, we create a set of house plans. We also have affiliated with us a company that can supply all of the building material, framer, roofer, plumber, electricial, etc. I want to include with the plans that are drawn up, a letter that offers our other services as well.
