I'm in a bit of a bind. My brother has given up his Power of Attorney in mum's affairs. She's in a nursing home. I am in the process of applying for Guardianship as mum recently failed a mental capacity test and can't make the decision to make me POA.. . In the meantime, it has come to my attention that my brother's ex-wife (he went through a nasty divorce last year) has all of mum's bank statements and other personal documentation! My brother now lives in NSW. I'm on the Gold Coast, but my ex sister-in-law is up in Cairns (where they lived together), where mum lives.. . Is there any way I can make a demand for this personal documentation? She also has all our family's old furniture and other personal effects, and has been holding these things 'ransom' to get a more favourable outcome for her divorce settlement. I have her lawyer's contact details and have tried previously (in vain) to get my childhood photo album back, I never heard anything back from him (or my ex SIL). I really don't have the money to go through a lawyer myself, but surely there must be a letter of demand or something I can write!?. . Any advice would be appreciated..
