    well first off..the doctor's were incorrect in telling her she "had" to put her husband's last name. the birth mother has the right to put the FATHER'S last name on the birth certificate even if it differs from her own, or her current spouses. i dont even know why a doctor would be involved in the naming of a child, that is usually handled by the hospital's vital records "keeper", NOT the doctor...so he probably had some sort of "moral reason" for doing this and it was completely wrong on his part, actually....she *could* sue the doctor for meddling, but that's another matter. . anways.....the birth mother (not your brother) needs to call the county courthouse and ask for the county clerks office, to speak to someone in the 'vital records/birth records' department, and get information on filing a name change for her child. they will set up a court date and will need to provide a DNA test for the child and your brother. once paternity is proven, a name change will be granted BUT only after the girlfriend's husband signs off on the child. (meaning he makes no claim to the child in question), she really should think about divorcing him though. your brother can certainly contact an attorney about it, but it's not necessary as the county clerks office will have all the paperwork that he and his girlfriend will need to fill out. having an attorney would just cost more for them in the long run. people do name changes all the time w/no attorney present. however, if they live in a state that honors marriage over DNA, they might have difficulties unless she divorces first. she would need to divorce her husband, and provide DNA that the child is not the husband's so he can sign off on the child, and pay no support to the mother...then they can file for a name change for the child.
