It's enough to have these documents in your possession. However it is always a good idea to have a copy with a lawyer or trusted friend or family member with information concerning the location of the original. I have seen cases where the executor or agent was unable to locate the original when the testator or principal was dead or unavailable. That makes for a bad situation and results in the document having little or no effect or value. If a person executes a power of attorney then the agent should have access to the POA in the event it is needed. It can be held by the attorney and given over to the agent under pre-specified conditions including the absence of the principal or in cases where the principal has developed dementia (if it is a question of a durable power of attorney).

My husband began filing for bankruptcy 4 years ago in 2005 (before we even met). He started the process with his lawyer. We met in 2006 ang got married in the early part of 2007. I knew that he had filed bankruptcy and we both thought it was done with. Shortly after we got married he received something from one of the creditors seeking collection on the account. At that point we contacted his lawyer to find out why we would have received this and to verify that the creditor was included in the bankruptcy. Turns out that it wasn't final. We wrote him another check to file some more paperwork and never heard anything from him. Called him several times and finally set up an appointment which got canceled and rescheduled several times. He claimed that he did not file the paperwork with the correct address and it got kicked back. Then in the Spring/Summer of 2008 we get a letter from the Bankruptcy court saying that it has been dismissed (the case, not the bankruptcy) meaning that there was something wrong with the paperwork again. We scheduled an appointment and after several go-rounds of canceling and rescheduling my husband is going in today to meet with him and get to the bottom of this.

A contract was drawn up with a time line to complete a project. The majority of the work was completed. However, several small aspects of the project was not completed at the time specified.. . The party contracting the work now would like to have a complete refund, although the contracted party is willing to complete the project.. . Is the contractor entitled to a complete refund - or partial refund - based on the amount of time, effort and work completed by the contracted party?. . In other words, is the contracted party entitled to compensation for the work already completed in the contract even though the entire project was not completed at the deadline specified?. . The contractor has not been impacted in a way that would "injuriously" impact him or his business..
