  • Ms. Ormond has been practicing law since 2006 and joined the firm in 2010 as an associate. Tort reform limits your ability to seek redress under the law in ALL of the above cases, not just the medical cases. It also limits what you can recover, regardless of what your injuries are. $250k might be hunky dorey for the 85 year old man who was paralyzed when his doc used Lovenox during back surgery, a drug with a black box warning placed by the FDA because it can cause paralysis in back surgery, but $250k isn't so hot for the baby who suffered brain damage at birth because the doc used Cytotec, another drug with a black box warning that warns against its use in L&D. In that case the baby suffered brain damage. The mom died. Bled to death due to a ruptured uterus. Says right on the box not to use it, but doc didn't know that. The brain damaged baby also only gets $250k, but for his lifetime of care, he will need much more than that. By age 3 he will be through that, and then he will be placed on Medicaid, which is paid for by the taxpayer. Of course, if you have no Medicaid, his healthcare will be paid for by the taxpayer. This baby has no ability to ever hold a job, but he still must be cared for. And the mommy who died? Her family didn't get to sue for her wrongful death at all. Dead equals noneconomic damages, and you don't get to sue for that.
