  • Joe Calhoun is a registered patent attorney seasoned in both business competition and technology protection law. Mr. Calhoun has earned over twenty-five years of experience and judgment in commercial litigation and counseling, and he has been honing his craft in intellectual property law since approximately 1993. His primary practice areas include procurement and transfer of rights in patents, trademarks and copyrights, as well as enforcement of (or defense against) claims involving such intellectual property rights. Throughout the years, Mr. Calhoun has also assisted numerous clients in business start-up organization and expansion, commercial competition, employment issues, and a wide variety of business contracts and disputes. He does so in a manner which is readily understandable, prompt, and cost effective. When suggested by client circumstances, Mr. Calhoun crafts creative legal solutions for businesses and individuals in need of guidance and courtroom representation, confident in his ability to work both smarter and harder.

After earning his Bachelor of Science degree from Tulane University, and graduating from the University of San Francisco School of Law in 1983, Mr. Calhoun started his legal career as an associate with Tarkington, O'Connor and O'Neill in San Francisco. He subsequently returned home to Little Rock, Arkansas and clerked for the Arkansas Court of Appeals. Mr. Calhoun then entered private practice with a well established business law firm, departing as partner on the eve of 2000 to better concentrate his legal practice in the areas of patents, copyrights, trademarks and business competition. Yet Mr. Calhoun continued to maintain his license to practice law in the State of California, and over the years he has represented a number of clients in litigation in California (and eight other states). Mr. Calhoun is expanding his California legal practice, returning to his "legal roots" by associating with O'Connor and Associates as "Associated Counsel".

As a registered patent attorney, Mr. Calhoun offers legal expertise that many law firms do not always have in-house. Mr. Calhoun is often retained through referrals from clients' attorneys or accountants, and he greatly values his working relationships with such referral sources. Naturally when his services are retained through such referrals, Mr. Calhoun adheres to a "no poaching" policy, voluntarily limiting his engagement to the matters he was retained for.

  • O'Connor and Associates is a premier litigation boutique, with acknowledged excellence in trial practice and procedure. In addition to its trial and litigation services, O'Connor and Associates offers litigation avoidance counseling and early dispute resolution capabilities.

O'Connor and Associates is by design nimble, proactive and efficient. Matters are handled primarily by the principal attorney John D. O'Connor. Additional staffing is added only as needed, through a network of experienced lawyers and paralegals who associate regularly with O'Connor and Associates. Each task is assigned to a lawyer with appropriate capabilities and experience, in keeping with the philosophy that a client’s case is too important to be a training exercise.

Substantively, firm attorneys have proven successes in a wide range of subject matter areas, characterized broadly as business, business tort, property damage and personal injury litigation. The firm has both pursued and defended a wide range of contract, fraud, unfair competition, employment, environmental, product liability, director and officer, professional liability, and other statutory and tort claims. Economic sectors in which O’Connor and Associates has significant experience include real estate, government, banking, insurance, advertising, manufacturing, high tech and biotech, hospitality and gaming, sales and distribution, construction and professional.

Even though all litigation by its very nature involves risk and uncertainty, O'Connor and Associates is willing to provide focused projections of likely success that will often become more certain as trial approaches. It is a core philosophy of the firm that significant trial experience is crucial not only in devising successful litigation strategies but also in evaluating accurately the likelihood of success at trial. Astute evaluation, in turn, is critical to achieving a sensible, confident resolution of disputes, whether through mediation, direct negotiation, trial or other alternative dispute resolution procedures.

The record of success of O'Connor and Associates attorneys in any particular area can be more fully explicated as applicable to a particular client’s situation. References from a wide variety of attorneys, other professionals, former judges and clients will be provided, as discretion permits, upon request.

is there any way to get a power of attorney online?

My mother and father set up an irrevocable trust for me when I was a little boy. When I am 25, I am able to collect up to 25% of the trust, which is approximately $25,000 for housing or educational purpose. I will be 25 on 1/1/12. Here is my situation. My father doesn't want me to have the money for whatever reason. My mother does. I do. The trustee is pretty much a friend of my dad's. The money is not being spent, just being controlled by my dad and the trustee. Is there a way for me to relieve the trustee and find one who will follow the orders of the trust without ripping out my pocket book. I have a friend who is an attorney who I feel is qualified to be the trustee. I'd like to find another attorney to be attorney for the trust. I'd like to relieve the current trustee and block my dad out, and find a new trustee to be in charge. I am seeing some personal behaviors by my father that are leading to me to stop trusting him and ths is why I am doing this.. Who gets to decide who the new trustee is?.

Terms of Service are an agreement between two people. If you are not going to enter into a sales or purchasing relationship then you do not need to worry about having Terms of Service. That said, many websites use email newsletters to maintain relationships with visitors to their site. It is a great way to promote your expertise. If you decide to get a "Subscribe to My Newsletter" web form on your site you should state that their email address will never be rented or sold. That is the most basic Terms of Service you can have on a web site that does not have any visitor purchasing anything. Good Luck.
