Since your ex pays child support, I'm assuming that he does have at least partial custody even though you have her most of the time. If this is correct, you are required to either get his signature or after your court date he will get official notice of the petition and have a chance to oppose it.. . From what I can tell, you pretty much need to get her father on board with it if he has any parental rights still, regardless of his presence in her everyday life.. . In this day and age, though, I really think it's unnecessary to change her name. I mean, blended families are EVERYWHERE. She will feel like a black sheep if you treat her like one, her last name isn't really going to make a difference unless she's treated differently. The school should be used to having different last names from the same family, because, like I said, blended families are super common. If anything, I would think changing her last name would lead to confusion in the long run and a separation from her birth father, which is rarely a good thing (unless he's abusive or something in which case he shouldn't have rights anymore).
