OUTDOOR PERFORMANCE: If performance is outdoors, an alternate inside location will be provided or purchaser assumes all weather-related risk. Artist will be due full wage agreed upon in the event of inclement weather unless the event is moved to alternate location prior to set-up. Artist will only set up once and will not be required to move the equipment to alternate location after set-up has begun.. THE ARTIST, leader, manager, or representative of the Artist agrees and guarantees to pay 10% of FULL WAGE AGREED UPON for personal services, booking fee, Contract fee, and telephone expense rendered and incurred in this transaction to Agent. This commission is due and payable when all parties have signed this Contract and must be paid within five days after the date that the Artist is to perform for the Purchaser except where Agent has already retained said commission from the deposit already paid by Purchaser. If leader or key personnel of this group is rebooked into this or any establishment represented by the Purchaser (including chain buyers of entertainment) within 13 months from the Performance(s) set forth in this Agreement, Purchaser and leader shall be jointly and severally liable for payment to the Agent for commission in the rate set forth herein.. THE AGREEMENT of the Artist to perform is subject to detention or prevention by sickness, accidents, riots, strikes, epidemics, acts of God, or any other legitimate conditions beyond their control.
