Again, consult a lawyer. I have no experience with New York law and it may be different than my home state.

Powers of attorney come in two types, general and specific. If you give your brother a general power of attorney you enable him to take any action on your behalf that you yourself would be able to take. If you designate him as your agent for a specific purpose, such as sale of a vehicle or a piece of real estate, then the power only is valid for that purpose. Also, make a power of attorney revocable, and for a specific length of time. That way you are able to revoke it at your option, and you are legally protected if you specifically word the power as to say what he can and can't do under the POA.

My father is a retired real estate attorney but he dealt mostly with commercial real estate dealings rather than the residential closings where you are used to seeing one. My real estate company has a real estate attorney on retainer to address any potential issues that the agents come accross and to answer questions the principal broker doesn't know. We also have the resource to call one of the real estate lawyers that work for our state real estate commission. It takes 3 years of tough school to graduate law school and a bit longer to take and pass the Bar exam, all of which is required to become an attorney of any kind. And as long as you have a license to practice law, you are capable of being a real estate lawyer. In my state the law doesn't require you be a lawyer to do closings but since the lawyer represents the bank at closings most closings are done by lawyers despite the simplicity. I have had two clients that have hired real estate lawyers to sue sellers as a result of perceived errors they received in the seller disclosures after they bought their houses. One won a good chunck of change because the seller ommitted some water damage he absolutely had to be aware of, but tried to hide. Many real estate lawyers are best at doing closings and not as good in the court room.. . In real estate, lawyers are also paid to do title searches, but what most don't realize is that the title work is almost always farmed out for a fraction of what it the lawyer charges for the work. If you ever go down to your county court house where the title records are stored you will likely run into the 2 or 3 young lawyers who spend their entire days down their doing title searches for all of the other lawyers in town.
