If you have having problems with the executor of an estate which you are the beneficiary you should get your own lawyer.. The executor (commonly known as the Personal Representative) of an estate that is going through Probate is responsible for paying estate's final bills, locating assets and following the wishes outlined in the deceased's Last Will and Testament. Beneficiaries of the estate, by law, are to be kept informed for the duration of this process and should receive copies of all probate documents that have been filed. One of the documents a devisee (person named as beneficiary in a Will) will be provided with is an Inventory which lists all of the assets "stuck" in the deceased's persons name (alone). Life insurance proceeds that name a beneficiary are not stuck in the deceased's name so they do not need to be probated - the person named as beneficiary should be able to collect the insurance proceeds after producing a death certificate to the insurance company.. Probate is a complicated process, so again, I advise that you get your own lawyer if you believe the Personal Representative is not doing his/her job.
