  • David B. Rheingold specializes in an active trial practice primarily involving drug product and medical device liability cases. Since joining our firm in 1993, he has concentrated on the mass tort cases, most recently hip and knee implant litigation in both federal and state courts. This includes the following implants: Biomet M2a, DePuy ASR & Pinnacle, Stryker, Wright Medical, and Zimmer. For knee implants, he litigates in federal court for the Zimmer NexGen knee implant. He litigates hernia and pelvic mesh cases in state and federal courts against the following defendants: AMS, Bard, Boston Scientific, Coloplast, Ethicon, and Gynemesh. Drug litigation is also a large part of his federal and state practice and includes: Benicar, Yaz/Yasmin/Beyaz, NuvaRing, Fosamax, Actonel, Boniva, Heparin, Levaquin, and Reglan. His direct involvement in management of specific litigations includes courts in New York, New Jersey, and federal courts throughout the United States.

    He is the managing partner for the firm’s cases in the $2.5 billion DePuy ASR metal-on-metal hip implant settlement plan; $100 million NuvaRing settlement program; the $56 million Biomet Magnum and 38 M2a hip implants; and the $27.7 million settlement program for the firm's Fosamax osteonecrosis of the jaw cases. He has used his medical expertise in preparing the firm's "Extraordinary Injury" and "Enhanced Injury" claims for recent medical device litigations: Medtronic Defibrillator, Guidant Defibrillator, Medtronic Sprint Fidelis Lead litigations, DePuy ASR and Biomet hip implants. The Rheingold firm had leadership positions in Medtronic and Guidant litigations which settled for $118 million, $195 million and $268 million respectively.

    As an active member in the American Association for Justice, City Bar Association of New York, and the New York State Trial Lawyers, he has access to litigation resources and materials throughout the United States. His is the co-chair for the Fosamax and Other Bisphosphonates Litigation Group. This local and national experience makes him a valuable lecturer to other trial attorneys on handling mass tort cases, and he provides annual lectures to New York State Trial Lawyers at the annual "Decisions" seminars throughout New York State. He has been a guest lecturer at law schools and the Attorneys Exchange Information Group.
