My family is buying a property, currently signed the contract under only my son's name. we are paying a down payment 250k from my bank account. the mortgage broker needs me to sign a letter saying I gift it to my son because the property will be only under his name. my question is , is it taxable ? I know the max gift per year is 12k from me and 12k from my spouse tax free . But the life time tax free gift should be 1 million. Isn't that even if I gift 250k this year and it should not be taxable unless i gift more than 1 million ? I would rather add my name on this purchase if it will be taxed as a gift. . Is there any IRS or NYS taxation website will show the detail about this gift tax rule ?.
