    Actually, power of attorney can't be claimed, it has to be given.. . There are a couple of options here, but both will require examination by a specialist to determine her mental state.. . If she is found to be mentally functional (there is a specific legal definition), she can fill out, sign and notarize a power of attorney (I would also recommend a living will).. . If she is found to be mentally non-capable, your partner can petition the court to be declared her guardian, which has a few more restrictions than power of attorney but should cover all needs here.. .
