Does your written agreement specifically give you the right to repossess without notice to the buyer? My sense is that it does not - considering the police would not allow you to take the vehicle.. . But frankly, this depends on the law in your state. (And considering you did not identify your state, it is impossible to say whether or not you have the legal right to repossess the property.) Your only option might be to sue him/her in small claims court for the balance.. . But your question seems to indicate that the buyer made all of the car payments to the finance company until the vehicle was paid off. It would be interesting to know how much the buyer has paid and what the Blue Book value of the vehicle is. If the buyer made a significant amount of payments - it is unlikely repossession would be an appropriate remedy. You likely should have left the plates on the vehicle and sued for the balance due.. . But if the vehicle is impounded, you will be notified and will be able to get it out of impound.. . RESPONSE TO ADDITIONAL DETAILS: What does your agreement state? You say you have the right to repossess pursuant to the agreement but then you also say the agreement should be void because the application was denied. Did the agreement specifically state that the denial by the finance company would void the agreement? Does the agreement provide a specific purchase amount for the vehicle?. . CAN you repossess the car? Yes. But you likely need to go to court and get an order allowing you to do so because it sounds as though the buyer will have enough information and evidence to argue for ownership of the vehicle.
