Power of Attorney. . A power of attorney is the grant of legal rights and powers by a person to another. They stand in the shoes of the person with a disability and acts for him or her on financial, business, health care decisions or other matters. In most cases, even when the power of attorney is immediately effective, the person with a disability doesn't intend for it to be used unless and until he or she becomes incapacitated.. . Representative Payee. . This is a person appointed to manage Social Security, Veterans' Administration, Railroad Retirement, public assistance or other state or federal benefits or entitlement program payments on behalf of an individual. The representative payee acts much like an attorney-in-fact, but for the limited purpose of a particular program.. . Medical Proxy. You designate a person to make medical decisions for you at all times, or simply to be consulted at will, or to make decisions in the event you are incapacitated.. . When a person has a guardian they lose most of their rights as a person. They cannot enter into any contracts - including marriage, cell phone, rental. They cannot vote. Who ever becomes the guardians takes on tremendous risk - financial and emotional- the person who has a guardian is not prosecutable for a crime, but their guardian is (for instance in the case of a theft - you would be required to pay fines and restitution.)
