• Mr. Foster has been practicing with the same firm as a civil litigator since graduating from law school in 1983. While he practices generally in the area of torts and insurance law, including products liability law, he has focused in recent years in representing burn victims in fires which have been caused by, or accelerated by product defects in ordinary consumer or building products, many having excessive flammability properties. Among these are upholstered furniture, mattresses, decorative plywood paneling, clothing and acrylic bathtubs. Many involve mobile homes. Mr. Foster stays abreast with judicial and legislative developments in these areas.

  Lawing vs. Trinity Manufacturing and Matrix Outsourcing, Opn. No. 5166, S.C. App., Filed Aug. 21, 2013. (Product liability case. Court reversed grant of summary judgment to defendants, granting new trial to Plaintiff Lawing, holding that Lawing, who was an employee in a pipe rack cutting pipe causing sparks to fall upon the product at issue, plastic bags of sodium bromate, a highly flammable combination which caused an explosion, was a “user or consumer” of the product as defined under S.C. Product Liability Act and entitled to bring strict product liability claim. Further, that the sophisticated user doctrine is the law of S.C., and was not preempted by the federal OSHA law which required the bags to be marked as hazardous materials.

  Wallace Graham v. Progress Energy, Inc., 2010 U.S. App. Lexis 13086 Decided June 25, 2010, unpublished. (Mr. Graham used candles to illuminate his home the evening following Power Company's wrongful termination of electric service. He forgot to blow out all candles and a fire fell on a sofa. The ensuing fire caused him catastrophic injuries. The Fourth Circuit overturned a grant of summary judgment, holding the trial court erred in finding no proximate cause because it was unforeseeable Graham would forget to blow out the candles before retiring to bed. Progress' web site urged the use of caution in placing candles for light during power outages. The NFPA evidence also showed 34% of all home candle fires occurred with unattended, or abandoned candles during a study from 1999 - 2001)

I am getting into a business venture with my friend in toronto , what kind of contract do i need ?

Does anyone know of a software that can do this, or of any other way of doing it. . My company uses this procedure often, but nobody knows who made it or how it is done.

Affidavitt is a written statement of fact. Such as what you saw at an accident or crime scene, or what you know about a law suit or some such.. . Power of Attorney is a permission for someone to make decisions for someone else. Either both parties have to agree and sign the power of attorney, or the court can issue the power of attorney. For example a person gets too old to take care of their finances and too old to make medical decisions so the court issues a power of attorney to an adult child of the old person, so the adult child can pay the old persons financial debts and make health decisions for the old person.

It depends on how your email is set up.. . The type of handset is less important than the tools available.. . BlackBerry handsets have made an art of the business email facility, so much that people often forget they have to be set up.. . I have a Samsung and a BlackBerry and can access both business and personal mail on each - but the business one was set up for me.. . I know that sometimes you need to 'push' email with an 'exchange server', though for the life of me, I don't know what that means :). . If you are using Microsoft Office then they may have details on their site.. . If you are using your local telco or ISP account, then maybe they can help.. . More details, possibly more help. . JeM

When my Ukrainian mother broke up with my biological father (Moorish) when I was 3 she changed it to her own, Ukrainian last name. 10 years later she married a polish man, my step dad. I was forced to change my last name to an extremely polish sounding name. Not to mention a lot of kids at school actually asked why my last name changed.. . I don't feel associated with Polish people (no offense) and dont particularily look like one (darkhair/eyes). Since I'm almost 18 I had the power to legally change my last name. Should I do it? I'm hesitant because I know people will notice and ask my why I did it.. yeah thats the problem, my step dad has been like a real dad to me and has taken care of me for most of my life. I don't even know my real dad, he left when I was 3.
