I just found out I had a default judgment ordered against me (civil..for credit card debt) and by reading online court documents that a notice of garnishment/levy was filed by the creditors attorney against me (hasn't been served to me). Problem is that I haven't been served anything, ever...nada nil...so I know I can file a motion to quash service of summons, a motion to set aside default judgment and an order (?) to lift garnishment/levy. I would like to do it all on one form, a general motion template provided by the state but am unsure if I have to file all three separately or if the motion to quash service would be enough and if successful would make the other two (judgment and garnishment/levy) disappear. I really don't want this on my record as it will effect many aspects of my financial life moving forward and I was in no way served properly. I'm going to the court house to get the specifics of the affidavit of service soon and plan on pursuing the matter myself as I cannot afford an attorney right now and need to quash this before any levy or garnishment can be enforced. Thank you.. Is it necessary to file more than just the motion to quash service of summons and go before the judge based on that and argue the facts? Would a favorable outcome for that nullify the judgement and garnishment/levy? I'm just wondering if it is overkill to do all three motions. I mean if the service of service is upheld (it shoudn't be) I wouldn't be able to argue the other two motions successfully I'm sure. .
