How can I successfully start a business ?

I think it would be a mistake on the part of the Trustee to want to have an agent (power of attorney) to act in any fiduciary capacity on behalf of a Trust. A corporate trustee (bank or trust company) would not have a convicted felon as their agent.. . It is really a bad idea to have a convicted felon as an agent under a power of attorney, but if individuals are trustees, they are free to decide to do whatever they want with regard to the trusts they administer.

EnchantedCropper is actually wrong. Any emergency contact is simply an emergency contact - they get the call if something is wrong with you.. . If you were to be incapacitated or deceased, the closest next of kin would legally have the power to make decisions for you. They would be able to make health care decisions and funeral arrangements. Usually, your next of kin is a spouse, then any adult children, then a parent, and so on.. . If you want to avoid this for whatever reason, you need to have a living will and a durable power of attorney set up in advance. This designates your wishes and allows you to choose what happens to your stuff if you die along with funeral arrangements (which you can leave up to your durable power of attorney).
