• Dave Alden's practice focuses on product liability and, in particular, on defending actions involving pharmaceuticals, tobacco, and consumer products in trial and appellate courts around the country. He also has substantial experience defending accounting malpractice, RICO, and securities actions. Dave regularly counsels clients regarding attorney-client privilege and attorney work product protection issues and has defended challenges to such claims in several jurisdictions.

  For several years, Dave represented Wyeth as national coordinating counsel in actions relating to Wyeth's prescription antidepressant. That representation has involved, among other things, a month-long jury trial and appeals to the Fifth, Seventh, and Tenth Circuits. He also has represented medical device manufacturers in actions relating to personal injuries and economic losses. For more than 20 years, he has represented R.J. Reynolds Tobacco Company as national coordinating counsel in smoking and health product liability actions, again in trial and appellate courts around the country. For two years, Dave was an in-house attorney for a major accounting firm, where he defended the firm in malpractice, securities, and RICO actions.

  Dave has appeared in state and federal trial courts throughout the country, including in southern Illinois, Louisiana, Mississippi, Minnesota, and West Virginia state courts, and has represented and advised clients in multiple appeals. He participated in the nine-month bench trial in United States Department of Justice v. Philip Morris USA, Inc., et al. (D.D.C.) and in jury trials in Giles v. Wyeth (S.D. Ill.), Nunnally v. R.J. Reynolds Tobacco Co. (Cir. Ct. DeSoto County, Mississippi), and Cordial ex rel. Blue Cross Blue Shield of West Virginia v. Ernst & Young (Cir. Ct. Kanawha County, West Virginia).

  Dave has published several articles addressing, among other things, the attorney-client privilege and attorney work product protection. He is a member of Jones Day's electronic discovery committee. Dave recently coauthored a book on drug and device litigation (in press), the Ohio chapter in Product Liability Desk Reference: A Fifty-State Compendium, and law review articles addressing medical device preemption and waiver of Ohio's statutory attorney-client privilege. He also, along with the Ohio Innocence Project, represents inmates seeking DNA testing on a pro bono basis.
