If they incorporated in your state with that name, before you did, you are probably out of luck. You might want to think of another one and start using it before you get a letter from their attorney (they'll just ask you to stop using it, first letter is no big deal unless you ignore it).. . I don't think you'll be able to establish a strong enough case that you have had significant brand recognition over the years to be able to force them to give it up.. . However, I had this exact situation come up 25 years ago (I was X Co, they were X Corp). The owner of the newly incorporated company called me and we had a nice chat on the phone. Turned out our businesses were quite different, we were not serving the same customers or taking business from each other, so they nicely agreed to let us keep using our name so we didn't have to reprint business cards and stuff. This was long before the Internet and cheap printing so it was an issue back then. Maybe you'll be this fortunate.
