I had my son and he was registered with his biological fathers name. We split years ago. My sons grandad from his fathers side is a registered sex offender so I got my sons last name changed to my name as we were not married and he was born before may 2006.. I'm now getting married to my daughters father (my childhood sweetheart) so we will all have the same name except my son. My fiance has treated him like his own and never said anything different I would like him to have the same name as the rest of us so he is not left out or feels out of place.. Can I do this and how? We are domestic partners living in Delaware (civil unioned in NJ) and are looking to prepare joint wills. There are two choices that confuse us: 1) married or 2)single. In the state of Delaware's eyes we would be considered single. However, the joint will will be submitted to my employer as proof of domestic partnership for benefits, which they do offer for domestic partners. We need to sign an affadavit and submit with several choices of proof, one of which is a joint will. Does it matter which one we choose? My original instinct is to choose the "married" version b/c to us we are together...richer or poorer, sickness and health, til death do us part. But will that be deemed invalid since DE (as well as other states) doesn't recognize us as a married couple?
