• Since joining Jones Day, Randy Hawkins has been involved in a variety of litigation matters, including product liability, antitrust, civil rights, construction, and commercial litigation proceedings. He has handled many aspects of litigation, including factual investigation, depositions, and motions practice. He has represented clients in state and federal courts and has argued before the U.S. District Court for the Northern District of Georgia and the U.S. Court of Appeals for the Eleventh Circuit.

  In addition to his work for some of Jones Day's larger clients, Randy has been active in the Firm's pro bono practice. Recently, he represented the Tahirih Justice Center, a nonprofit women's advocacy group, as intervenor-defendant, in a case challenging the constitutionality of a federal statute requiring international marriage brokers (IMBs), commonly known as "mail-order bride agencies" to provide information to foreign women about their legal rights and certain background information concerning their prospective American husbands before entering into such a relationship. The lawsuit, which received national media attention, represented the first attempt by an IMB to resist the regulation of the industry. In finding the statute constitutional, the District Court for the Northern District of Georgia noted that the law "is highly likely to reduce domestic abuse - and may actually save lives." Randy also represents low-income families with disabled children through the Jones Day Special Education Advocacy Project.

how to format a legal memo to a client I am a paralegal student?

Your teacher would be the best person to ask.. . I would think you could just use a spiral notebook or a binder with loose paper.. . Non-fiction articles would be ads in the paper, a flyer that came to your house, a magazine article, a newspaper story, etc. . When you read the article or ad, ask youself: What is the purpose of this? Does it provide information? If so, it is to inform. Does it advertise a product? If so, it is to sell something. . Is it a funny story that is true? If so, it is to entertain.. Is it a letter to the editor? If so, it is to state an opinion or to persuade others to agree with one's way of thinking. (Often letters to the editor are political in nature - either bashing a politician or trying to get votes for him/her). . Genre would probably be editorial, advertisement, movie or book review, etc.

My answer is presuming that you are in a community property state:. . 1. In the first scenario, the husband's transfers would be invalid as to wife's share (assuming a death or divorce). In other words, the husband can't unilaterally take community property and make it separate property. The wife would be entitled to her portion of those proceeds. She may also be entitled to more than that if the husband acted fraudulently.. . Also, there may be a malpractice issue if the husband had an attorney. You're not allowed to assist your clients in circumventing the law.. . 2. If there is already a trust established, then that remains the husband's separate property (or whatever under the terms of the trust). The wife has no claim to the money or property that was in the trust as of the date they married. However, any money/property put in after marriage would be community property, and the wife would again be entitled to her share.. . 3. The husband's health doesn't matter in this equation. The only way it might have a bearing is if it affects his mental capacity.
