Hi i am going through the courts in Parramatta at the moment (Family Law Courts) my ex wants our daughter to bear his name only ( it is currently Hyphenated) because i have since married and changed my name. (we are both also going for residence of her).. Basically the judge stated unless there were extenuating circumstances of a horrific nature such as if either me or my ex were convicted of molestation and it was splashed in the newspaper and it could affect the day to day living of the child or it was in the best interests of the child to change it only then would the courts order a change and due to the fact that i ahev a huge family with the surname and the fact that she has identified with my family for most of her life they will not order the change.. I think you could have a legitimate argument for change however, In your case think carefully before you bring this man back into your sons life as unless he has been convicted of major crimes murder, rape, molestation or leads a life full of drugs he will get access if he wants it.. The courts suck and they now work on the premise of shared parental responsibility.. With my daughter it has only been the last 2 years that he has wanted to see her and i was happy for him to do so. But because he has settled and about to marry he wants her to reside with him and due to the courts he has an actual shot.. they have subponead my bank records, centrelink, her school everything... My daughter is 8... What i done with my daughters name was at school she was known by my surname only and on medicare my surname only registered with Centrelink mine only.. So why don't u do that and then when he turns 18 he is legally able to change his own name.. Otherwise you would have to risk approaching hime to sign the form to change it.. He may just sign it especially if he knows that Child support maybe an issue.. No-one likes to pay child support... My ex has an actual shot because i moved from the state and he refused to allow her to come.. The courts actually stepped in and said that she was to remain in NSW until its sorted so they placed her with MY mother that was 8 months ago and it doesn't look like its going to be sorted until March 09.. We have no allegations of abuse or anything like that in fact he said that i was a great mum but he is just not happy with school holidays!!. . So if your sons father wants access he will get it whether it be every second weekend from 9- 5 etc etc depending on where he lives.. The courts are all for children having relationships with both parents first they will make you go to mediation and attempt to come up with some agreement if that fails only gthen are you able to file in court and yes they have access to everything that went on in mediation so if you are negative against the whole process it will work against you..
