Dave Torborg has extensive experience in a wide variety of complex commercial disputes, with an emphasis on litigating and resolving financial disputes and investigations. He has worked extensively on allegations of accounting fraud in connection with business sales, claims of auditor malpractice in connection with the collapse of a large health care system, and government investigations of corporate accounting and cost reporting. With his educational background in finance and accounting, Dave has played key roles in identifying and researching theories of liability, deposing fact and expert witnesses, and developing and challenging damage calculations.
Dave also has significant experience in health care and False Claims Act litigation. Most recently, he had substantial responsibility for defending a pharmaceutical client in False Claims Act litigation brought by the U.S. Department of Justice relating to the sale, marketing, and pricing of pharmaceuticals. In the course of that representation, Dave deposed federal and state officials regarding drug reimbursement policy, wrote briefs supporting dispositive and discovery motions, and worked extensively with expert witnesses.
Dave also has been actively involved in litigating contract and general business disputes, both at jury trials and through arbitration. He has significant litigation experience relating to supply contracting, executive compensation, insurance coverage, defamation, and indemnification.

A decedent's estate consists of the property of a deceased person. A trust (sometimes called a "trust estate" to keep things confusing) consists of property placed in the trust's name by a living entity. (the "donor") Usually that means a person, but it can be a corporation, or a decedent's estate. Trusts created by a decedent's estate are called "testamentary trusts." Usually they are created for an estate beneficiary that cannot take property on their own name, either because they are minors, or incompetent, or for tax or other reasons.. . A "successor personal reprsentative," or "successor trustee," is simply a person who takes over if the original named personal rep or trustee cannot continue in that position for any reason.
