Your MIL is probably became the beneficiary of an irrevocable spousal trust that receives $ form the family trust of which she is now the trustee. She can only pass the benefits on to the kids though gifts, dying or is found incompetent. The latter is extremely difficult and could possibly get your husband taken off the trust completely. Most likely the trust split and part was made irrevocable when your FIL died, to protect his wife from the kids attempting to have her deemed incompetent and putting her in a low rated nursing home while they live the high life. You may think that's silly, but I assure you it has happened and now trust lawyers are very careful about it. Ours even has a clause that any fighting among siblings where one hires a lawyer to challenge it will get them kicked off the trust completely. In short, just because your FIL passed you still have to wait for MIL to pass before you can buy that yacht. Hopefully she won't spend all the money before she passes. I am surprised that FIL and MIL didn't pass out copies to each of the children when the trust was first made. I received one from my Parents when they first made it and when my Husband and I made ours we gave a copy to my Brother until our son is old enough.
