Here's the situation: Daughter is both executor and has unlimited and durable power of attorney. She wishes to sell her father's properties to pay for medical expenses and home care as he is unable to take care of himself. However her brother (her father has only two children) claims this is unfair as he expects to be given a share upon his father's death. So she has decided to come to an agreement with him and give him 1/2 of everything - the other half to be used for his medical and home care expenses. Is she allowed by law to do that? His living will has no mention of what to do with his property/assets. Thank you for the help.. The half would be enough to pay for all his existing medical bills with some left for future expenses. And she's agreeing to it because the brother is causing her father a lot of stress by calling him at the care facility and poisoning his mind that she is using the money for her personal gain (which is very far from the truth). The incident happened at Claire's in the state of Maryland. I attempted to shoplift $47 of merchandise and was stopped before turning to leave the store. I am 18 years old, female, and have a clear record so far. I have not yet received notice of my court date, as it has only been a few days since the incident. I plan to plead guilty. If I have to go to court over it, do I have to pay a civil demand if one is sent? From my understanding, a civil demand from Clarie's is an out of court settlement so that charges are not pressed.
